/Видео/ В Комрате представители правительства и региональных властей обсудили судебную реформу

Представители четырех министерств Молдовы посетили Гагаузию с рабочим визитом. Это госсекретари министерства юстиции, инфраструктуры, труда и социальной защиты, сельского хозяйства. На встречу с ними были приглашены примары городов и сел автономии. Но пришли и члены исполкома и депутаты НСГ, отметив, что вопросы, которые будут затронуты на встрече, касаются не только примарского корпуса. Члены правительства к такому повороту не были готовы, но препятствовать не стали.

Первыми с докладом выступили госсекретарь Министерства юстиций Руслан Лунгу и директор Агентства по администрированию судебных инстанций Сорин Попеску. Они проинформировали присутствующих о том, что парламент принял во втором чтении законопроект о пересмотре судебной карты.

«Реформирование карты судебных инстанций не направлено на ущемление прав и свобод граждан и не намерено ограничить доступ населения к юстиции. Предполагает собой лишь повышение эффективности судебных инстанций и более легкий доступ населения к судебным услугам», — сказал госсекретарь Министерства юстиций.

С этим мнением не согласились депутаты Народного собрания. Вице-спикер НСГ Георгий Лейчу отметил, что внимательно следил за тем, как идет работа по реформе судебной карты. Он подчеркнул, что при принятии данного решения нарушены права Гагаузии, прописанные в законе «Об особом правовом статусе». К тому же не были учтены и особенности административно-территориального устройства страны.

«Вулканештский район, являясь составной частью автономии, передается в судебный округ другой административно-территориальной единицы. При том, что органы, осуществляющие содействие правосудию: прокуратура, полиция и другие констатирующие органы функционируют в автономии как единый организм, распространяя свои полномочия, в том числе и в Вулканештский район. Как в этой ситуации могут быть обеспечены элементарные права граждан на доступ к правосудию?», — отметил он.

Госсекретарь Министерства юстиций Руслан Лунгу отметил, что нет необходимости в какой-либо связке между судебными инстанциями и прокуратурой того или иного района.

«В части уголовного преследования я не вижу здесь никаких препятствий. В части же остальных административных дел и в части языка в том, числе. Суд Вулканешты остается на том же месте с теми же судьями», — сказал он.

Было отмечено, что реформа карты судебных инстанций будет проходить постепенно и до 2027 года должно произойти слияние судебных инстанций.

«Куда люди будут обращаться? В Вулканешты или в Кагул? И второй вопрос: куда прокурор должен обращаться, если преступление совершено в Вулканештском районе? Он должен обратиться в суд соседнего района или в Комратский суд?», — задался вопросом вице-спикер НСГ Георгий Лейчу.

На этот вопрос ответил директор Агентства по администрированию судебных инстанций Сорин Попеску.

«В настоящее время в Вулканештсом суде только один судья. Согласно статье 313, он должен обратиться в суд Комрат. Комрат находится в 80км. от Вулканешт. Кагул в 22 км», — ответил директор Агентства по администрированию судебных инстанций Сорин Попеску.

В ответ Георгий Лейчу привел в пример города Тараклия и Твардица, которые находятся в непосредственной близости к Чадыр-Лунге.

«Почему их тогда не переводят в округ Чадыр-Лунги? Причем жители Твардицы и обслуживаются районом Чадыр-Лунги. Почему они должны обращаться в суд г. Кагул, что в 120 км, а не в Чадыр-Лунгу?», — сказал Лейчу.

Этот вопрос остался без ответа. Реформа судебной карты судебных инстанций кроме реорганизации судов  предусматривает и реорганизацию апелляционных палат. Представители Министерства юстиций отметили, что Апелпалата Комрат будет сохранена.

«Нигде в законе не предусмотрена ликвидация Апелляционной палаты Комрат как физического здания и судей, которые будут здесь работать. Мы все понимаем, что кроме уголовных и административных и гражданских дел Апелляционная палата Комрат, предусмотренная законом «Об особом правовом статусе Гагаузии» выполняет и определенные электоральные функции», — отметили в Министерстве юстиции.

Коснулся Лейчу и кадровой политики, подчеркнув, что Высши совет магистратуры препятствует приему выпускников вузов в Национальный институт юстиции.

«Ни одного представителя Гагаузии не было предложено и назначено на должность судьи или прокурора. Чем объяснить вот такое отношение?», — спросил он у представителей правительства.  

Руслан Лунгу отметил, что такими данными не обладает, но подчеркнул, что критерии отбора Национальный институт юстиции едины для всех и каждый гражданин имеет право подать документы.

«Трижды межпарламентская рабочая группа единогласно голосовала за необходимость внесения поправок и корректив в политику государства в этой сфере. И ни одного действия со стороны министерства на этот счет предпринято не было. Поэтому и вопросы возникают, почему у нас судей нет. В Вулканештах 1 судья и он ждет, когда уедет. В Комрате — четверо, трое ждут, когда уедут отсюда, в Чадыр-Лунге ни одного судьи не осталось. Все потому что люди из центра, и они к себе на родину хотят», — сказал Георгий Лейчу.

Сорин Попеску отметил, что нет препятствий в назначении судей. И в кадровой политике избирательного подхода нет.

«Я уверен, что судей назначают исходя из территориальной принадлежности», — ответил директор Агентства по администрированию судебных инстанций.

Спикер НСГ Дмитрий Константинов отметил, что законопроект о пересмотре судебной карты был принят без учета мнения властей и жителей Гагаузии. Также он выразил свое недовольство тем, что на встречу с госсекретарями министерств не были приглашены  представители НСГ и исполкома автономии.

«Вы уже приняли закон и сегодня вы собираете примаров. Надо было раньше собирать. И посоветоваться. Вы не учли мнение жителей. Вы не посчитали, что им нужно будет ездить в другие районы и сколько трат будет на это. Вас это не интересует. И для людей эти 100 леев, поехать в Кагул и обратно, это тоже деньги. И еще, вы не учли главное, что у нас есть автономия», — отметил спикер.

Отметим, что реформа карты судебных инстанций предполагает, что офис Южной апелляционной палаты будет находиться в Кагуле. Районные суды Комрата и Чадыр-Лунги будут отнесены к суду Комрат, тогда как суд Вулканешт перейдет в ведение суда Кагул, наряду с судебными инстанциями из Кантемира и Тараклии.

Напомним, что на встрече с представителями примарского корпуса, исполкома и НСГ присутствовали госсекретари еще трех министерств страны. О вопросах, затронутых ими, ГРТ расскажет в следующих новостных выпусках.
